Terms and Conditions for the ‘Drug & Bug Screen’ (The Product) and all associated goods

1.

Even though the product is manufactured in food grade plastic the company cannot accept liability for allergic reaction.

2.

The product is not retailed in sterile packaging therefore the company cannot be held responsible for any harm caused as a result of use of the product. The product must be thoroughly washed before use.

3.

The product is produced at a size to pass current ‘choking hazard’ regulations recommended by UK Trading Standards.

4.

The product is intended for use on specific cans only: small screen – 330ml cans, large screen – 440ml cans. No liability can be accepted by the company for the misuse of the product.

5.

The company recommends the product be used under adult supervision for children under the age of 16 years.

6.

The company recommends the product be discarded safely after use. No liability can be accepted by the company for the deterioration of the product if used continuously.

7.

The product is designed to allow fluid to be drunk through while securely attached to the can top by inserting under the opened ring pull and over the open aperture of the can. The company will not accept liability for any mishap caused by the product being used in any other manner.

8.

The general use of the product is to reduce the risk of drugs and bugs (insects) contaminating the beverage within the can. The company cannot be held responsible or liable for the failure of the product. Very small insects and drugs in liquid or powder form may pass through the product.

9.

Property in and the title to the product are not passed to the buyer until the product has been paid for in full; the risk in the product shall pass to the buyer on delivery to the buyer or its carrier. If the buyer shall in respect of the product fail to pay the price thereof in full on the due date thereof the company shall (without prejudice to any other remedy it may have) be entitled to demand their immediate return and the buyer shall forthwith return the same. If the buyer shall sell any of the goods (the product) or shall use or incorporate them with any other product which shall sell or shall otherwise deal with, alter or treat and then sell before in each case the same shall have been paid for in full then although as between the buyer and its customer the buyer shall act and sell or otherwise deal as principle and the property in and the title to the goods may pass to the customer as between the buyer and the seller (the company) the buyer shall sell or otherwise deal with the product and hold the proceeds of sale thereof or such proportion thereof as represents the sellers unpaid price for such goods to the buyer as trustee upon trust for the seller to whom such proceeds or due proportion shall belong.

10.

In respect to death or personal injury caused by the company and proven by the appropriate English Court due to negligence directly by the company. The companies liability herein shall not exceed the value of the contract.

11.

Payment terms are stated on the order agreement and if are not adhered the company reserves the right to charge interest at the rate of 16% per annum on any sums overdue under this agreement from the date when such sums become due until payment.

These Terms and Conditions shall be construed, operated and be enforced in all respects as a contract made in England in accordance with the laws of England and the buyer shall submit to the jurisdiction of the appropriate English court.

When you place an order for the product in any of the ways described above you are offering to buy it for the price stated, subject to these terms.

When you place your order online we will send you an email to confirm that we have received it. This email confirmation will be produced confirming your order details and date of dispatch.

4.

Drinksafe Ltd may cancel any sale and not supply the goods if it is reasonable to do so and may change or discontinue the availability of the goods at any time at its own discretion. If an order is cancelled, any payment made for the goods will be refunded in full. This does not affect your Statutory Rights.

All new orders are deemed separate and each is treated individually

 

Price

1.

All prices shown are total prices per item, delivery costs if applicable will be show as an extra and created automatically when ordering.

2.

Prices shown on the Drinksafe website will be in UK pounds – outside the UK your credit card company should exchange the amount charged to the currency of your country at the current rate. Please note that both charges and refunds are in UK pounds and Drinksafe Ltd cannot be held responsible for any loss due to exchange rate fluctuations.

Non EU customers are responsible for Import Duty/Tax in their respective countries. Unfortunately we cannot advise you what these costs will be – please consult your local customs office for more information.

 

Payment

1.

You must pay for your order before it is delivered and you can do so by credit card, debit card, or cheque.

If your delivery address is outside the UK and you order online you must pay by credit card.

To ensure that shopping online is secure, your credit/debit card details will be encrypted to minimize the possibility of someone being able to read them as they are sent over the internet.

All order details and invoices will be sent to the credit card billing address and not the delivery address where the named recipient of the order differs.

By Cheque

 

In the UK, you may pay by cheque.

Please make cheques payable to Drinksafe Ltd and remember to include postage. Please also send us a covering letter detailing your order, cheque guarantee card number, guarantee amount, expiry date, contact details and delivery address.

 

Availability

1.

If we cant supply the goods you will not be charged for it and we will refund or re credit your account with the amount debited by us.

 

Delivery

1.

Drinksafe Ltd delivers to destinations inside and outside the UK.

2.

You will be notified of the delivery costs before you submit your credit card details.

3.

Delivery outside the EU my be subject to local import taxes, which are your responsibility where they apply. If so, the shipping company should contact you by telephone once the goods are in customs to let you know the charge due or else you should consult your local customs office. Unfortunately we cannot advise you what these charges will be and Drinksafe Ltd is not responsible for them.

4.

Drinksafe Ltd offers a standard delivery of 2-3 days.

5.

Orders are dispatched by Royal Mail 1st Class.

6.

We will make every effort to deliver within the time stated above but we will not be liable for any loss caused to you by late delivery.

7.

If the goods are not delivered within the estimated delivery time, please contact us by telephone or email and we will investigate the reason for the delay. If you wish you may cancel your order and we will refund the money you have paid. Please note that while items sent by Royal Mail usually arrive within 2-3 days , Royal Mail stipulate that only items still not delivered after 15 working days can be officially classified as lost.

8.

This does not affect your statutory rights as a consumer.

Drinksafe Ltd makes a commitment to protecting your privacy and promises only to use information collected about you in accordance with the Data Protection Act 1998.

When you place an order, we may ask you for certain information and you may submit personal data to Drinksafe Ltd. This information will be kept securely in accordance with our internal security policy and may be used to process your order only and we will never collect sensitive information about you without your explicit consent.

 

Returns

We believe that you will be delighted with your product but there may be occasions where you feel it necessary to return the item. We aim to keep the process as simple as possible and these terms do not effect your statutory rights.

We will try to attend to all returns as soon as practically possible.

Drinksafe Limited Responsibilities

1.

Drinksafe Ltd has tried to make the description (including pictures) of the product as accurate as possible.

2.

Drinksafe Ltd shall insure ordered products at their retail value whilst being delivered to you. Please check the delivered products as soon as possible on receipt as we will not cover any subsequent loss or destruction.

3.

Drinksafe Ltd will provide its services with reasonable skill and care but does not give any guarantees, warranties or representations in respect of any other persons service.

4.

Because of the nature of the internet Drinksafe Ltd provides and maintains Drinksafe Ltd on an ‘as is’, ‘as available’ basis and makes no promise that use of Drinksafe Ltd will be interrupted or entirely error free. We are not responsible to you if we are unable to provide our internet service for any reason beyond our control.

Except as provided above we can give no other warranties, conditions or other terms, express or implied, statutory or otherwise and all such terms are hereby excluded to the maximum extent permitted by law.

You will be responsible for any breach of these terms by you and if you use Drinksafe Ltd in breach of these terms you will be liable to and will reimburse Drinksafe Ltd for any loss or damage caused as a result.

These terms above shall not limit any rights you might have as a consumer that may not be excluded under applicable law nor shall they excluded or limit Drinksafe Ltd liability for death or personal injury resulting from its negligence nor any fraudulent representation.

Drinksafe Ltd will not be liable in any amount for the failure to perform any obligation under his agreement if such failure is caused by he occurrence of any unforeseen event beyond its reasonable control including without limitation internet outages, communications outage, fire, flood, war or act of God.

9.

Please read the instructions that come with the product carefully. Drinksafe Ltd is not involved in the manufacture of any product and will not advise on their use or operation or the manufacturers guidelines. You are urged to use all products safely and in accordance with the manufacturers guidelines.

These terms do not affect your statutory rights as a consumer which are available to you.

Subject as aforesaid, to the maximum extent permitted by law, Drinksafe Ltd excludes liability for any loss or damage of any kind howsoever arising, including without limitation any direct, indirect or consequential loss whether or not such arises out of any problem you notify to Drinksafe Ltd and Drinksafe Ltd shall have no liability to pay any money by way of compensation, including without limitation all liability in relation to:

Any interruptions to or delays in updating bugscreen.co.uk

The infringement by any person of any Intellectual Property Rights of any third party caused by their use of Drinksafe Ltd or product purchased through Drinksafe Ltd.

Any loss or damage resulting from your use or the inability to use the Drinksafe Ltd web site or resulting from unauthorized access to, or alteration of you transmission or data in circumstances which are beyond our control.

Any loss of profit, wasted expenditure, corruption or destruction of data or any other loss which does not directly result from something we have done wrong.

Any amount or kind of loss or damage due to viruses or other malicious software that may infect a users computer equipment, software, data or other property caused by persons accessing, using or downloading Drinksafe Ltd, or from Drinksafe Ltd or its licensees and affiliates.

All representations, warranties, conditions and other terms which but for this notice would have effect.

 

General

1.

Drinksafe Ltd may change or withdraw any part of its web site, or may refuse you access to the web site at any time if we consider it necessary.

2.

Drinksafe Ltd may also terminate this agreement and immediately remove, cancel or suspend access to and use of the web site upon breach of any part of these terms whatsoever.

Termination shall be without prejudice to Drinksafe Ltd’ s other rights

Drinksafe Ltd acts as principal on its own account and not as agent for you or any other person.

5.

If Drinksafe Ltd does not enforce any provision of his agreement such will not be considered a continuing waiver.

In the event that any part of these terms is held to be unenforceable, such part will at Drinksafe Ltd ‘ s option be construed as far as possible to reflect the parties intentions and the remainder of the provisions will remain in full force and effect.

7.

These terms constitute the full agreement between you and Drinksafe Ltd and may only be amended in writing. They apply to the exclusion of all other terms or conditions of contract proposed.

8.

Since we are principally aiming Drinksafe Ltd at the UK and EU market, we cannot guarantee that it accords with local laws of any other countries (though we will try to make sure it does).

Use of Drinksafe Ltd and these terms are subject to the laws of England and the jurisdiction of the English Courts.
